Misrepresentation risk you should catch at intake

Misrepresentation — direct or indirect, including by omission — can make a client inadmissible and trigger a bar of several years, plus a permanent record that shadows every future application. Advisers are also exposed: filing something you knew or should have known was false is both a regulatory and, in serious cases, a legal problem.

Screen these at the first consult

• Prior refusals or removals anywhere. Ask about every country, not just the destination. An undisclosed US visa refusal surfacing later reads as concealment.
• Previous applications filed by someone else. Get copies. Ghost consultants and relatives often submit inflated or invented histories the client has never seen.
• Employment and education gaps or overlaps. Reconcile the CV against documents before it goes anywhere near a form.
• Family composition. Non-accompanying dependants must still be declared and, where required, examined. A child omitted now blocks their sponsorship later.
• Identity and name variations. Different spellings, a changed name, or an earlier passport with a different date of birth need to be explained upfront with documents.

Handling what you find

If the client has an earlier application with false information, you cannot simply file a clean version and hope. The discrepancy is on the record. Advise them candidly about disclosure and the risk, put the advice in writing, and let them decide with full information. If they insist on proceeding with something you believe is misrepresentation, decline the retainer and document why.

The paper trail

Keep the client's signed declarations, your written advice on any risk area, and copies of the source documents you relied on. If a misrepresentation allegation ever comes, the file needs to show you did the diligence.
